Importer Self Assessment (ISA)

US Customs’ audit risk pool isn’t where an importer wants to be swimming.  A US Customs Focused Assessment audit is intrusive, lengthy, disruptive, and usually costly. But did you know there is a way whereby an importer can virtually eliminate themselves from being targeted for an audit? It’s called Importer Self-Assessment, or ISA.  ISA is a program offered and supported by US Customs. The ISA program is a voluntary approach to trade compliance, built on knowledge, trust, and an importer’s willingness to maintain an ongoing relationship with US Customs. The program offers meaningful benefits and can be tailored to your organization’s needs. It requires that importers prove readiness to assume responsibilities for managing and monitoring their own compliance through self-assessment. ACE Account

If you are an importer, having an US Customs ACE (Automated Commercial Environment) account is a necessary part of trade compliance. ACE is the platform on which all US Customs activity does or will eventually take place. An ACE account gives an importer visibility into all of their US import activity through a variety of customized reports. Among the benefits of having an ACE account are the ability to respond directly to US Customs’ Requests for Information as well as file Formal Customs Protests. Voluntary Disclosure

The fact is that compliance reviews and transactional audits sometimes uncover past errors that resulted in a Loss of Revenue (LOR) to US Customs. If such an error is identified internally by any means, it is incumbent upon the importer to disclose this information to US Customs through a Voluntary Disclosure, often referred to as a Prior Disclosure. The primary benefit of a Prior Disclosure is the avoidance of penalties that would have otherwise been assessed had US Customs discovered the error. The filing of a Prior Disclosure must take place very shortly after the discovery of a potential US Customs LOR error. If US Customs commences a formal investigation into a potential LOR error or errors an importer has made, that importer can no longer enjoy the benefits of filing a Prior Disclosure. Free Trade Agreement (FTA) Eligibility Assessments

The US has entered into numerous Free Trade and Trade Promotion agreements with countries around the world. These agreements reduce and often eliminate duties on many eligible products. However, proving eligibility within any agreement is a complex process, and importers often make FTA claims that cannot be supported. Ineligible FTA claims can result in monetary damages and/or penalties being assessed against the importer.
